Introduction

Within the framework of its commercial activities, Octopus Logistics processes information about you. You provide us with personal data that enables us to identify you via various channels on our site. Your browsing of our website, your request for a quotation via the form, for example, are all channels through which we collect personal information. Octopus Logistics attaches great importance to protecting and respecting your privacy. This Privacy Policy tells you how we collect your personal data. It is based on the following reference texts: Regulation (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data. French Data Protection Act 78-17 of January 6, 1978, as amended. We only use your personal data in the cases provided for by the regulations in force:

  • The performance of a contract we have entered into with you, and/or
  • Compliance with a legal obligation, and/or
  • Your consent to the use of your data, and/or
  • The existence of a legitimate interest in using your data. Legitimate interest is a set of commercial or business reasons that justifies the use of your data by Octopus Logistics.

1. The data we collect

1.1. Data transmitted directly

During the various contacts we have with you, you may be asked to provide us with information about yourself. Here are the different harvesting points that can be identified on our site:

The data collected from these points includes :

  • Lastname
  • Firstname
  • Email Address
  • Phone
  • Company
  • Any other information you would like us to know about via the “Message” fields.

This data may concern information necessary for the commercial relationship established beforehand when the commercial contract was signed between Octopus Logistics and your company.

1.2. Automatically collected data

We collect information relating to your connection and navigation during each of your visits to our site. The main technology used to collect this data is the cookie.

Data collected via cookies

A cookie is a text file that is stored in a specific area of your computer’s or mobile device’s hard disk when you visit a website, application or online advertisement. Cookies are managed by your Internet browser, and only the sender of a cookie can decide whether to read or modify the information it contains. For more information, please visit our cookie management page. Octopus Logistics uses the Google Analytics cookie for the proper functioning of its website.

Data collected by standard Internet technologies

We may also use standard Internet technologies such as scripts, pixels and redirects. Scripts (sometimes called tags), written in javascript language, are programs that run in your browser and perform various actions, such as sending information to our servers. Scripts can also create pixels. Pixels (sometimes called transparent GIFs, clear GIFs or Web-bugs) are lines of code used to display a graphic image (usually invisible) on a Web page or in an e-mail. Redirects make a web page available under multiple page addresses (URLs). When a browser opens a redirect URL, a page with a different URL is opened.

1.3. Data provided by mobile devices

Some mobile devices send information such as your phone model, operating system version and type of connectivity. This data is automatically processed by our servers and those of some of our partners (notably OVH and Google Analytics) in order to provide you with a service and measure the audience for our site.

1.4. Data relating to minors

In principle, our products and services are aimed at people of legal age who are capable of entering into contractual obligations. www.octopus-log.com is not intended for minors. Users who are minors must obtain the consent of their legal guardians prior to the communication of personal data concerning them.

1.5. Exclusion of all sensitive data

Octopus Logistics does not collect any sensitive data about you. Sensitive data includes all those listed in Article 9 of the RGPD and in particular: racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, data concerning health, sex life or sexual orientation, genetic or biometric data. If such information is communicated to us in any way, it will be deleted.

2. Purpose of use

In this article, we present the purposes for which we use your data mentioned in article 1.

2.1. Operations required to supply products or services

  • Customer relations: a dedicated person is available to answer your questions at contact@octopus-log.com;
  • Management of the exercise of your rights to your personal data, under the conditions set out in article 7.

2.2. Marketing and sales prospecting operations relating to Octopus Logistics publications, products and services

  • Sending commercial emails
  • Sending emails about product or service changes
  • Sending emails relating to marketing offers
  • Creation of a database of all our customers and their personal information.
  • Enrichment of a database dedicated to prospects who have contacted Octopus Logistics via the website.
  • Personalized sales prospecting

2.3. Purposes associated with depositing cookies on your browser

Operation and optimization of navigation on our sites and applications

  • Adaptation of the presentation of our sites and applications to the display preferences of your terminal (language used, display resolution, operating system, etc.) during your visits, according to the hardware and software for viewing or reading that your terminal has;

3. Data retention period

Your personal data will be stored for a period of time that complies with legal provisions or is proportionate to the purposes for which it was recorded. Certain retention periods meet the legitimate interests of Octopus Logistics as specified in the introduction. Retention periods vary depending on whether we have an ongoing contractual relationship with you (you are an active customer), whether we have had a contractual relationship with you in the past (you are an inactive customer) or whether we have never had such a relationship with you (you are a prospect). The data relating to your browsing of our online services collected by the cookies you have authorized is stored for a specific period of time.

3.1. Data categories

  • Active customers: The aim of collecting and storing data is to manage customer relations as effectively as possible, and to keep them informed of product developments and new features in our solutions. Data is kept for the duration of the contractual relationship.
  • Inactive customers: The aim of keeping data on inactive customers is to be able to continue to send them information on our products and developments in our solutions. Data is kept for 3 years from the date of unsubscription or last contact with the customer. Some data may be kept for longer than three years to meet other legal obligations.
  • Prospects: The aim of data collection is to build up and manage a file of prospects. Data is kept for 3 years from the date of collection or last contact with the prospect.
  • Data generated by cookies : The Octopus Logistics website uses Google Analytics cookies to analyze and measure site traffic and user navigation. This data is kept for 13 months.

4. Access to the data we store

4.1. Data access within Octopus Logistics

The following may have access to some of your data:

  • Marketing and sales staff.
  • The data collected via the various forms on the site are stored in office suite files, which are themselves stored on the limited-access computer network.
  • There are 1 files: quote request
  • Other contacts (customers) are recorded on a CRM software package to which only Octopus Logistics employees have access on the basis of authorizations issued by management.
  • Employees are subject to an obligation of confidentiality laid down in their employment contract.

4.2. Data transmission

The following may have access to some of your data

Subcontractors

They provide services on our behalf, in particular:

  • Handling telephone calls, sending postal or digital mail
  • Emailing
  • Maintenance operations and technical developments
  • Provision of analytics solutions or audience measurement statistics (Google Analytics, WordPress)

4.3. Social networking platforms

The use of social networks to interact with our sites and applications (in particular the Linkedin and Twitter “share” buttons) is likely to lead to data exchanges between Octopus Logistics and these social networks. For example, if you are connected to the Linkedin social network and consult a page on the www.octopus-log.com site, Linkedin may collect this information. Similarly, if you consult an article on the www.octopus-log.com site and click on the “tweet” button, Twitter will collect this information. We therefore invite you to consult the personal data management policies of the various social networks to find out how they collect and process your data.

4.4. Our sales partners

Octopus Logistics does not currently provide advertising space on its site. However, you may come to octopus-log.com via other sites that do. They promote products or services on their own behalf or on behalf of advertisers. We draw your attention to the fact that if you decide to subscribe to the products or services of our commercial partners and you allow them to access some of your information, in particular by connecting to their sites or applications, their confidentiality policies and their cookie deposits are enforceable against you. We have no control over the collection or processing of your data by our business partners on their own platforms.

As data controller, we implement appropriate technical and organizational measures in accordance with applicable legal provisions, to protect your personal data against alteration, accidental or unlawful loss, use, disclosure or unauthorized access, and in particular:

  • Setting up a department dedicated to information systems security
  • Raising awareness of confidentiality requirements among our employees who have access to your personal data;
  • Secure access to our premises and IT platforms;
  • Securing data access, sharing and transfer;
  • High standards of data protection when selecting our subcontractors and partners.

6. Your rights

6.1. Your right to access your personal data

You have the right to access your personal data and request that it be corrected, completed or updated. You can also ask for your data to be deleted, or object to it being processed, provided you have a legitimate reason for doing so. You can ask to exercise your right to data portability, i.e. the right to receive the personal data you have provided us with in a structured, commonly used format and the right to transmit this data to another data controller. Finally, you can formulate directives concerning the conservation, deletion and communication of your personal data after your death. Before responding to your request, we may verify your identity and/or ask you to provide further information in order to respond to your request. We will endeavour to respond to your request within a reasonable time and, in any event, within the time limits set by law. In the event of an unsatisfactory response, you can lodge a complaint with a supervisory authority. In France, this is the CNIL (Commission nationale de l’informatique et des libertés).

6.2. Your right to object to commercial solicitations

We may use your contact information for commercial solicitations in accordance with applicable law and the provisions of this privacy policy. You may object to these solicitations at any time, depending on the communication channel we use to send them to you.

Electronic commercial solicitations (e-mail)

We respect the rules of article L.34-5 of the French Post and Electronic Communications Code, which requires your prior and express consent for the sending of commercial prospecting by electronic means (e-mail, push notifications or SMS). However, your express prior consent is not required when you are already an Octopus Logistics customer and the purpose of our solicitation is to offer you products or services similar to those we already provide. In any case, you always have the option of objecting to receiving such solicitations by clicking on the unsubscribe link provided in each e-mail.
